Matthew H. Herlihy is an Associate in the Westchester office of Gordon & Rees and is a member of the Commercial Litigation, Product & General Liability, Automotive Litigation & Autonomous Vehicles, White Collar Criminal Defense, and Cannabis, Hemp, & CBD practice groups. Mr. Herlihy handles all aspects of product, automotive, and general liability related matters, including conducting initial case investigations, drafting pleadings, preliminary motions, dispositive motions, and summary judgment motions, conducting and defending depositions, attending conferences and routinely presenting oral arguments on behalf of his clients, participating in alternative dispute resolution, and negotiating favorable settlements.
Presently, Mr. Herlihy serves as outside general counsel to multiple building management companies, where he routinely provides counsel on issues related to insurance coverage, assists in policy restructuring, provides liability assessments and determinations, and assists in risk management with respect to ongoing or pending claims and/or litigated matters.
Further, Mr. Herlihy is a member of the Cannabis, Hemp & CBD practice group, where he monitors developments in the regulatory, compliance, finance, and banking sectors in order to advise clients regarding their Cannabis, Hemp, & CBD related business ventures.
Prior to joining Gordon & Rees, Mr. Herlihy routinely consulted on white collar criminal investigations, including representing clients in the construction and transportation industries in criminal and regulatory actions. These investigations ranged from alleged environmental violations, sanctions and potential penalties, to catastrophic construction site negligence matters.
Mr. Herlihy has extensive trial experience, which he gained from his time serving as an Assistant District Attorney with the Bronx County District Attorney’s Office. During that time, Mr. Herlihy tried 15 cases to verdict, while having many others plead out prior to reaching their ultimate verdict. Mr. Herlihy also conducted approximately 50 suppression/evidentiary hearings, presented more than 100 cases to the Grand Jury, and worked with expert witnesses in areas and practices including ballistics, DNA, fingerprint analysis, firearms analysis, collision investigation, toxicology, and others.
