Gordon & Rees Defeats Class Actions in Tea Label Cases After Full Dismissals Affirmed on Appeal

Gordon Rees Scully Mansukhani has successfully defeated a proposed nationwide class action claiming misleading labeling on behalf of a national family-owned tea manufacturer. Significantly, similar claims against other manufacturers have resulted in settlements totaling tens of millions of dollars. 

The Ninth Circuit Court of Appeals decision follows the defeat of class certification and full dismissal of the claims on summary judgment in 2016. In 2012, plaintiff attorneys filed more than 50 food labeling lawsuits against various national manufacturers in the Northern District of California.  One suit named Defendant, alleging that its promotion of the health benefits of antioxidants in its black and green teas violated FDA regulations.
