    Glenn LeMay is Assistant Managing Partner of the Houston office. He practices in the firm's Business Transactions, Commercial Litigation, and Bankruptcy practice groups.

    In practice for over 30 years, Glenn has served the business and litigation needs of a broad range of commercial clients, in areas including the construction, manufacturing, industrial, healthcare and professional service industries, as well as numerous physician groups and healthcare providers. He has trial, appellate, mediation, and arbitration experience, in state and federal court, defending and prosecuting claims on behalf of commercial clients in corporate, construction, and bankruptcy matters. In addition, Glenn is panel counsel for several major international insurers and defends E&O and D&O claims for clients in various industries, including accountants, auditors, title companies, business advisors, financial consultants, casualty adjusters, property managers, and debt collection agencies.

    He has extensive experience in Chapter 11 commercial bankruptcy cases, including representing creditors in prosecution and defense of claims by creditors and trustees and counseling clients on bankruptcy considerations related to their business operations.
     
    Glenn also has significant experience handling securities disputes before FINRA (and NASD prior to FINRA) related to broker-dealers, including claims involving misrepresentations, unauthorized transactions, unsuitable investments, commission churning, and excessive mark-ups relating to stocks, bonds, “penny” stocks, commodities, mutual funds, REITs, options, derivative securities, and other alternative investments. Prior to his legal practice, in the late 1970s, Glenn held the position of Lead Municipal Bond Trader for the largest bank in Houston.

    Examples of Glenn’s experience include the following:

    • Represented over 20 corporate and individual customers in obtaining multi-million arbitration award against major U.S. broker-dealer in case involving claims of unsuitability and unauthorized trading of junk bond securities.
    • Represented major industrial equipment distributor in Colombia in successful resolution of distributorship agreement dispute with U.S. counterpart.
    • Defended equipment leasing company in $36 million class action brought by equipment lessees.
    • Represented a major uniform rental company in post-closing lease dispute with multi-national purchaser of company.
    • Representing numerous physicians in resolving disputes arising from physician departures from practice entities, as well as dissolution of practice entities.
    • Represented numerous commercial employers and employees in disputes regarding enforceability of non-compete, non-solicitation, and non-recruitment covenants.
    • Represented Grammy-winning artist in successful resolution of contract dispute with former manager.
    • Represented numerous shareholders and corporations in resolving disputes arising from shareholder departures from corporations.
    • Represented numerous shareholders and corporations in resolving shareholder interests in disputes arising from dissolution and winding down of business entities.
    • Represented large commercial employer, at trial and on appeal, regarding claims against third party for acceptance of checks embezzled by employee.
    • Represented numerous commercial landlords and tenants in resolving landlord/tenant disputes.
    • Represented architect in successful resolution of design and construction defects case regarding construction of high-end commercial project.
    • Represented accountant/financial adviser in successful resolution of claims related to sales of Multiple-Employer Welfare Benefit Plans.
