    Megan K. Bailey is a Partner in GRSM’s Philadelphia office and is a member of the Environmental/Toxic Tort, Professional Liability and Insurance practice groups where she concentrates her practice in the area of complex mass tort litigation. 

    Megan has extensive experience representing steel-making facilities, chemical manufacturing companies, and numerous products manufacturers as both local and national counsel in the defense of personal injury lawsuits involving products and premises liability claims, including occupational and non-occupational exposure to asbestos and benzene. She also defends insurance brokers and title agents in professional liability matters.

    Megan also focuses her practice on commercial litigation, primarily in the area of insurance coverage representing and counseling insurance companies on a broad range of claims including long-tail toxic tort, environmental, professional liability and construction defect claims. 

    As national counsel, Megan effectively coordinates with local counsel across the country litigating thousands of claims to implement a winning legal strategy and collegial team approach to obtain great results for her clients.  She frequently achieves successful outcomes for her clients by obtaining dismissals at the pleading and summary judgment phases of litigation and by negotiating favorable settlements prior to trial, particularly in cases involving risk of large exposure.

    Prior to joining GRSM, Megan worked for a large, regional insurance defense law firm in Philadelphia where her practice involved complex mass tort litigation, insurance coverage defense, personal injury and workers’ compensation defense, and the protection of creditors’ rights.

    Megan is an avid fan of Philadelphia sports, a love that she shares with her husband and two young children.

    Representative Experience

    • Successfully obtained dismissal of complaint based on personal jurisdiction grounds in a chemical exposure case where client was facing large potential damages.
    • Successfully obtained a decidedly favorable settlement on behalf of an employer who operated a steel facility from which another former employee had obtained a multi-million dollar asbestos verdict.
    • Obtained summary judgment on behalf of a products manufacturer against allegations that use of the product caused mesothelioma on the basis that the product did not release respirable asbestos fibers.
    • Obtained dismissal of a complaint on behalf of a large steel manufacturer facing a potentially large exposure in a toxic tort case where the defendant/third party plaintiff joined the manufacturer in light of the landmark Pennsylvania Supreme Court case permitting a Plaintiff to bring a common law tort action against his employer.
    • Obtained summary judgment on behalf of a large medical packaging materials company where the plaintiff suffered chemical burns at work by obtaining dismissal of two defendants through preliminary objections and obtained dismissal of the remaining defendant on summary judgment grounds. 
    • Obtained summary judgment on behalf of an insurer in a breach of contract and bad faith action where the plaintiff-insurer sought reimbursement for settlement of a personal injury lawsuit which settled for over a million dollars.
    • Obtained dismissal of a complaint on behalf of an insurer where the insurer denied coverage to the insured for property damage resulting from a large construction defect case.
