    Robert Malani is a Partner in the Miami office of GRSM. From representing Fortune 100 companies and some of the largest financial services holding companies and lenders in the country to counseling small businesses and individual clients, Robert’s comfort with complex details has led to favorable results in a range of matters. His skills as a trial attorney are frequently utilized in commercial contract disputes, insurance matters, real estate contract disputes, and banking litigation, among other areas.

    • Represented an international aluminum manufacturer in a series of commercial contract disputes arising from a $400 million construction project.
    • Defended a global healthcare company in a national, multi-billion dollar litigation involving the manufacture, distribution, and sale of opioids.
    • Defended various businesses - including hotels, retail stores, restaurants, shopping malls, and schools, in single-plaintiff and class action claims brought under the Americans with Disabilities Act, including architectural barrier, website compliance, and retaliation claims.
    • Represented boat and vessel owners in maritime and admiralty matters involving personal injuries and the Limitation of Liability Act.
    • Represented a Fortune 500 company in a breach of contract action in the Middle District of Florida. Obtained a $2 million judgment and prevailed on a related appeal in the Eleventh Circuit.
    • Defended an online retailer in multidistrict litigation involving cybersecurity and data breach events.
    • Defended a national bank in litigation involving lender liability claims and obtained the dismissal of a seven-figure abuse of process claim.
    • Defended a credit card company in a class action lawsuit involving breach of contract and consumer protection claims.
    • Defended credit card issuers, student loan servicers, and automobile financing companies in litigation involving the Fair Debt Collection Practices Act ("FDCPA"), Fair Credit Reporting Act ("FCRA"), Telephone Consumer Protection Act ("TCPA"), Florida Consumer Collection Practices Act ("FCCPA"), and Florida’s Deceptive and Unfair Trade Practices Act ("FDUTPA").
    • Represented a lender in a breach of contract action involving the development and sale of commercial real estate and obtained a $4.5 million judgment.
    • Represented a national bank in litigation involving a defaulted loan secured by commercial retail centers in central Florida and procured the appointment of a receiver, sequestration of rents, and workout of a $9 million loan.
    • Negotiated and obtained a seven-figure settlement payment for a Fortune 500 company after being retained to enforce a dormant judgment.
    • Represented a creditor in a fraudulent transfer action in the Southern District of Florida and procured a judgment against a debtor who attempted to conceal assets in an offshore trust.
    • Represented a lender in litigation involving the foreclosure of a commercial office building in Fort Lauderdale and obtained a deficiency judgment in excess of $1 million.
