Scott Theobald and Mark Nickel Join the Phoenix Office

The Phoenix office is pleased to announce the recent additions of Scott Theobald and Mark Nickel as part of the current expansion of talent and practice areas in Phoenix.

Scott Theobald concentrates his practice on domestic and international corporate, securities and commercial transactions, corporate governance, real estate, and resolution of complex business disputes. During a career spanning nearly three decades, he has successfully negotiated a wide variety of business deals and resolved disputes on behalf of corporate clients ranging from Fortune 500 companies to high-tech startups. Theobald has a well-deserved reputation for creativity and innovation and, as a former engineer, he brings tremendous attention to detail to bear in every representation. He has deep practical experience with clients in a broad range of industries, including manufacturing, health care, real estate development, media and entertainment, public utilities, computer hardware and software, import/export, agriculture, environmental, high-technology, and financial and professional services, among others.
 
Theobald is fluent and literate in Spanish and has resided in several Latin American countries. He has represented a variety of U.S. and European clients engaged in acquiring businesses, manufacturing facilities and real property in Mexico and Central and South America.
 
Theobald has represented a number of emerging growth companies whose businesses often involve software applications and other means of commercializing the Internet.  One of his emerging growth clients grew in only eight years from "startup" to a New York Stock Exchange-traded company with a market capitalization of nearly $1.5 billion. Theobald also defends clients in investigations and enforcement actions brought by the Arizona Corporation Commission and, currently, he serves as outside general counsel for medical device companies located in Arizona and California, and for several large real estate investment partnerships.
 
Theobald received his undergraduate education at the University of Utah, where he earned a B.S. degree in Civil Engineering and a B.A. degree in Spanish, both magna cum laude. He received J.D. and M.B.A. degrees from Columbia University in the City of New York. He served as Managing Editor of the Columbia Business Law Review.
 
Mark Nickel focuses his practice primarily on general and complex commercial litigation, construction litigation, business tort litigation, securities fraud, corporate and partner disputes, real estate disputes, landlord and tenant disputes, creditors' rights litigation and professional negligence. He has represented clients in contract negotiations and enforcement in a wide range of matters involving real estate, securities, asset purchases, partnerships and other business transactions. He has represented clients in matters before the Arizona Corporation Commission and the Arizona Registrar of Contractors. He serves as outside corporate counsel for several small businesses located in Arizona and Utah. Nickel has extensive knowledge of and experience in electronic discovery (e-discovery) and data management. He also has experience in pre- and post-judgment remedies, and he has pursued and defended claims involving fraudulent transfers and alter ego- and successor-liability.  Nickel is admitted to practice in both Arizona and Utah.
 
Nickel received his B.S. degree in Economics from Brigham Young University, while working as a technical program manager for an Internet startup company. He directed engineering, programming, sales and marketing teams in developing, manufacturing and launching several early Internet devices, including a telephone-based email manager, an Internet-browsing device and an Internet set-top TV device. In 2006, he graduated from the Arizona State University College of Law, cum laude. While in law school, he served as a judicial extern at the United States Bankruptcy Court for the District of Arizona, and also in the United States Court of Appeals for The Ninth Circuit.
