Louisville Partner Denise M. Motta will present "You Can’t Handle the Truth, or Can You? Effective Use of Alternative Dispute Resolution for Resolution of Construction Disputes" at the 2024 DRI Construction Law Seminar in Phoenix, Arizona on January 17-19, 2023.
This presentation will cover dispute resolution provisions of most construction contracts, which contain clauses requiring mediation and arbitration instead of litigation in state or federal court. Motta will provide an overview of the various Alternative Dispute Resolution ("ADR") options available for the efficient resolution of construction disputes, including recommended best practices for preparing the dispute for the ADR process to obtain resolution either through early neutral evaluation, mediation, or arbitration.
Motta focuses her practice on construction litigation and the representation of steel fabricators and other parties on large construction projects, such as stadiums and bridges. She also represents owners, contractors, and subcontractors on a variety of construction issues ranging from construction contracts, collection of unpaid amounts, OSHA violations, mechanic’s liens, workers' compensation immunity disputes, and prevailing wage disputes. She is a panel member with the American Arbitration Association, Construction and Commercial.
