Partner Angela Richie to Present on Charge Orders and Back Charges for TSSI Quarterly Meeting

September 2024

Managing Partner Angela Richie will deliver a presentation entitled "How to Get Paid for Charge Orders and Defending Against Back Charges" for the Texas Structural Steel Institute ("TSSI") Quarterly Meeting in San Antonio, Texas, on October 25–26, 2024 at 8:30 a.m. Central.

Unpaid change orders continue to be one of the primary issues resulting in disputes on construction projects. This presentation will reiterate best practice recommendations for how to negotiate good change order provisions and prepare change orders to receive payment, including the proper documentation that is necessary if a claim arises. Richie will focus on the NEDD rule—Notice, Entitlement, Damages, and Don’t Waive Your Claims—as a system to ensure that change orders are supported and paid in timely manner. This session will also take a look at how to evaluate and respond to both valid and bogus backcharges with the goal of avoiding delays in payment and disputes.

Richie frequently consults with steel fabricators and other members of the structural steel industry on issues such as claims for non-payment, allegations of defective fabrication and erection of structural steel, OSHA violations and related retaliation actions, application of the Buy America(n) statutes and regulations, and contracts between steel fabricators, general contractors, and downstream detailers, structural engineers, and erectors.
