Gordon Rees Scully Mansukhani Westchester Partner Allyson Avila obtained a unanimous defense verdict after a five-day jury trial in Queens County, New York on behalf of the firm's client, a large catering company and its employee driver.
The plaintiff, a 36-year old male claimed that he was traveling through a green light when his motor vehicle was struck by the firm’s client. As a result of the accident, he sustained injuries to his right knee requiring surgery and injuries to his lumbar spine requiring a fusion surgery. The plaintiff’s last settlement demand after jury selection was $750,000.
At trial, Avila was able to establish that the firm’s client had the green light and it was the plaintiff who was at fault for the accident.
