On May 21, 2021, a Gordon Rees Scully Mansukhani California team led by Bay Area Partner Mike Laurenson and Senior Counsel Amber Eklof obtained a complete arbitration defense award for a Silicon Valley medical technology start-up before a San Francisco JAMS arbitrator.
Claimant was a territory manager who was terminated after he failed to make any sales in the first seven months of his employment. Following his termination, Claimant alleged that the company, the CEO, and VP of Marketing defamed him by telling “others” he “picks on” disabled individuals, interfered with his ability to obtain new employment by bad mouthing him to potential employers and violations of the Business and Professions Code regarding “blacklisting laws.”
After two days of arbitration, Claimant could not produce evidence or credible witnesses to support his allegations. In fact, the Arbitrator found Claimant’s star witness to be the “least credible,” raising questions about his “honesty and integrity.”
Claimant took nothing from Respondents by way of his Complaint.
