Gordon & Rees Texas Dram Shop Team Successfully Secures $665,000 Judgment Against Drunk Driver Co-Defendant

Gordon Rees Scully Mansukhani partner Philip Robert Brinson and Senior Counsel Delia Rivera successfully obtained a $665,000 judgment on behalf of a pool hall client in a Bexar County District Court in Texas.

The plaintiffs claimed that an alleged drunk driver was over-served at the client’s pool hall and bar, bringing suit against the client under the Texas Alcoholic Beverage Code’s statutory exclusive remedies provision allowing plaintiffs to sue providers of alcohol for over-service of guests. The firm filed a cross-claim against the alleged drunk driver, asserting that he had been drinking at another bar prior to the accident just before he struck plaintiffs vehicle.

The case was tried in May 2022 and was resolved between the client and the plaintiffs prior to closing arguments, but the client maintained its cross-claim against the alleged drunk driver.  Delia Rivera prepared the motion for judgment against the alleged drunk driver, seeking damages and costs, including the full amount of the settlement with plaintiffs and attorneys’ fees.  Delia Rivera argued the motion at the hearing before the presiding judge, after which the court granted judgment in favor of the firm's client.
