Jeremy Richter, Senior Counsel for Gordon & Rees in Birmingham, successfully obtained a dismissal with prejudice of a plaintiff’s breach-of-contract claim against an insurance company. Gordon & Rees had previously succeeded in causing every other claim in the case to be voluntarily dismissed by the plaintiff or dismissed with prejudice by the court.
In their most recent motion, Gordon & Rees moved to dismiss the case on the grounds that the plaintiff had abandoned the claim for breach of contract by failing to raise it in any of their amended complaints, which led to a complete dismissal of the case.
