GRSM Miami Team Obtains Dismissal with Prejudice of Claims Against Client Based in Australia

Miami Of Counsel Brooks Miller and Partner Andrew Schindler strategically obtained a dismissal with prejudice of claims asserted against a client based in Perth, Australia. 

The claims were related to a bid for a supply contract to a major international mining concern for its operations in Western Australia. The plaintiff alleged that the client and the co-defendant supplier misappropriated the plaintiff’s trade secrets and conspired to “rig” the bidding process by sharing and using the plaintiff’s allegedly confidential information.  

The Gordon Rees Scully Mansukhani team moved for summary judgment on behalf of the client, soundly refuting each of the plaintiff’s theories of liability. The motion was well-supported by documentation derived from discovery. When faced with the GRSM team's strong summary judgment motion, a series of upcoming depositions, including potential in-person depositions in Australia, and an impending trial date, the plaintiff requested a complete walkaway, resulting in a strong general release and dismissal with prejudice of the plaintiff’s claims against the firm’s client.
