Gordon Rees Scully Mansukhani Las Vegas Partners Robert Larsen, Brian Walters, and Wing Yan Wong secured summary judgment for one of the world’s leading suppliers of packaging technology in a breach of contract action based on the Uniform Commercial Code ("UCC"), involving equipment valued at nearly one million dollars.
The case centered on a rarely litigated issue concerning the revocation of acceptance of goods under the UCC and involved issues under Nevada, Wisconsin, and German law. The court ultimately found that the plaintiff accepted the client’s equipment and failed to effectively revoke acceptance under the UCC.
The court subsequently awarded GRSM's client over $248,000 in attorneys’ fees and costs, which represented over 99 percent of the amount requested—a rare level of success in the U.S. District Court for the District of Nevada.
