North Carolina Employment Law Team Secures Motion to Dismiss with Prejudice on Religious Discrimination Claim

Gordon Rees Scully Mansukhani Partner Kelly Brewer and Associate Benjamin Williams recently prevailed on a motion to dismiss in the United States District Court, Western District of North Carolina. The plaintiff alleged that her former employer created a hostile work environment due to her religious beliefs in violation of Title VII. 

The Gordon & Rees team argued that the plaintiff waited too long to file her lawsuit after receiving her right to sue letter from the the U.S. Equal Employment Opportunity Commission ("EEOC") and failed to exhaust her administrative remedies with the EEOC for all but one of the allegations in her complaint by omitting them from her EEOC charge. The court agreed with the Gordon & Rees team that the plaintiff waited too long and left too large of a gap between the conduct alleged in her EEOC charge and the complaint and dismissed the plaintiff’s claim with prejudice.
