GRSM Multi-State Team Obtains Dismissal of Civil Rights Claim on Behalf of Government Contractor

Gordon Rees Scully Mansukhani Nashville Partner Joshua Wilson and Raleigh Associate Benjamin Williams recently obtained a complete dismissal of a federal civil rights complaint on behalf of GRSM’s client, a government contractor that provides personnel services to federal government agencies, in the Eastern District of North Carolina.

The plaintiff alleged that his employer, GRSM's client, discriminated and retaliated against him based on his race and national origin in violation of Title VII. The plaintiff also alleged his employer violated the Whistleblower Protection Act and a federal law that protects federal contractors from reprisal for covered disclosures. Wilson and Williams argued that all of the plaintiff's claims against their client were barred because the plaintiff previously brought suit against the employer for similar allegations in a prior lawsuit, which was also dismissed.

The court agreed that the dismissal of the first lawsuit prevented the plaintiff from bringing the second lawsuit and dismissed the plaintiff's case for failure to state a claim upon which relief can be granted.
