GRSM Secures Complete Defense Verdict for Franchised New Car Dealership in Faulty Repair and Deceptive Practices Lawsuit

Gordon Rees Scully Mansukhani Partner Robert Bragalone and Senior Counsel Keith Robb prevailed in a jury trial in Collin County, Texas, obtaining a complete defense verdict for their client, a franchised new car dealership, sued for faulty repairs and deceptive acts and practices.  The plaintiff sued the dealership that serviced her 2014 sports car. In 2022 and 2023, she began experiencing situations where the engine would stop after hard braking from speeds over 40 mph. The dealership charged her for performing work on the sports car, including replacing a wiring harness damaged by rodents.  Nevertheless, her complaints about the vehicle shutting off during hard braking persisted. 

At trial, the GRSM team presented evidence that the repairs performed were necessary and that the engine shut down in situations where the plaintiff’s braking mimicked emergencies, causing the defendant to recommend that the plaintiff adopt a less aggressive braking habit, but she refused.  After blaming the dealership for the apparent “rat damage” to the sports car, and vehemently denying that rodents exist on her property, she promptly admitted that she has many squirrels on her property, completely unaware that squirrels are, in fact, rodents.  The jury returned a unanimous verdict for the dealership.
