GRSM Secures Dismissal for Train Equipment Manufacturer in Asbestos Exposure Case

New Jersey Partner Roy Viola achieved a significant legal victory for a train equipment manufacturing client in a wrongful death lawsuit filed in the Philadelphia Court of Common Pleas.

The estate of the decedent alleged that he was exposed to asbestos during his career as a maintenance worker for a major national railroad service, specifically implicating the client for purportedly manufacturing cranes that contained asbestos components.

GRSM pursued a dismissal from the outset of the suit, arguing that while the client had previously manufactured the cranes in question, they had sold the business years before the decedent began his employment with the railroad. After Viola filed a motion for summary judgment and opted not to engage in settlement discussions, the plaintiff ultimately agreed to voluntarily dismiss the case against GRSM's client.
