GRSM Team Prevails in Arbitration on Behalf of Clean Energy Industry Leader

September 2024

Gordon Rees Scully Mansukhani San Francisco Partners Michael Bruno and Amber Eklof prevailed in a hard-fought arbitration on behalf of the firm's client, a pioneer and leader in the clean energy industry.

The claimant, a former financial analyst at the company, alleged that GRSM's client terminated his employment just a few months after he complained about a denial of reasonable accommodations for his significant disability. Bruno and Eklof successfully argued that even though the respondent did not provide the claimant's desired accommodations, the company engaged in a good faith interactive process by offering legally sufficient reasonable accommodations. They demonstrated to the arbitrator that the claimant’s termination was based on work performance issues unrelated to his disability or his complaints about a lack of accommodations.

The arbitrator decided in favor of the firm's client on all counts. The order is final and not subject to appeal, thereby concluding the case efficiently and favorably for the client.
