Gordon Rees Scully Mansukhani San Diego and Albuquerque Partner Ted Yarbrough filed a successful Motion for Summary Judgment in New Mexico State Court. The case was brought by a well-known Texas and New Mexico plaintiff firm in a premise liability matter in which the firm represented a prominent national retailer.
The plaintiff alleged negligence, premises liability and gross negligence and was requesting economic, non-economic, and punitive damages. The plaintiff claimed severe injuries and permanent disfigurement due to the client’s alleged negligence and due to its failure to properly train its employees. Summary judgment is rarely granted in New Mexico State Courts, and the client and firm are pleased to have obtained this result.
