Allyson Avila Obtains Defense Verdict in Two-Week Trial in Bronx County New York

Gordon Rees Scully Mansukhani Westchester Partner Allyson Avila obtained a defense verdict after a two-week jury trial in Bronx County, New York on behalf of the firm's client.

The plaintiff alleged that he was injured on August 26, 2015 while driving a vehicle owned by his employer, as he was traveling along Interstate 95 in the City of New Rochelle, New York and was sideswiped by the client’s tractor-trailer.   

The plaintiff, 31-years old, claimed numerous injuries including cervical and lumbar disc herniations and had a lumbar fusion surgery.  He was unable to return to employment after the accident due to his injuries.  The plaintiff’s last settlement demand before trial was $6 million.

At trial, Avila was able to establish that the plaintiff entered into the client’s lane of travel and was the cause of the accident rather than the client hitting into the plaintiff. The firm's client was very pleased with this successful result.
